Terms of Service

Effective Date: October 7, 2026 • Governed by the Laws of India • Binding Electronic Contract

info Summary of Key Terms

By checking the agreement box during sign-in, accessing, or using SubGenius AI, you enter into a legally binding contract under Section 10A of the Information Technology Act, 2000. You retain 100% ownership of your content, certify that you have legal permission to transcribe it, agree that AI subtitles are provided "as-is" without warranty, and agree to indemnify SubGenius AI from third-party copyright or liability claims.

1. Acceptance of Terms & Electronic Contract

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and SubGenius AI ("Company", "we", "us", "our"). By creating an account, selecting an agreement checkbox, or using our website, APIs, or Studio software, you acknowledge and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the platform.

Pursuant to Section 10A of the Indian Information Technology Act, 2000 and applicable international digital commerce frameworks, electronic records and clickwrap agreements created through affirmative user action carry the full legal validity and enforceability of written, signed contracts.

2. The Service & Local-First Architecture

SubGenius AI grants you a revocable, non-exclusive, non-transferable, limited license to access and use our proprietary software platform for automated video subtitling, styling, and translation.

Our service operates via client-accelerated technology where video files remain on your local hardware. You acknowledge that subtitle burning and preview rendering occur in your browser environment, and that temporary audio processing occurs ephemerally across encrypted edge nodes solely to return subtitle text cues.

3. User Content Warranties & Indemnification

You retain full intellectual property ownership in all video, audio, and textual materials processed through your account ("User Content").

By processing any media through SubGenius AI, you explicitly represent and warrant that:

  • You are the sole author and owner of the User Content, or you hold all necessary licenses, permissions, and releases from the copyright holders.
  • Your User Content does not infringe upon, misappropriate, or violate any third-party copyright, trademark, trade secret, moral right, or privacy right.
  • Your User Content does not contain unlawful, defamatory, obscene, harassing, or tortious material.
Indemnification Obligation: You agree to defend, indemnify, and hold harmless SubGenius AI, its owners, operators, affiliates, licensors, and employees from and against any and all claims, liabilities, damages, losses, and legal expenses arising out of or in any way connected with your User Content, your violation of third-party intellectual property rights, or your breach of these Terms.

4. Artificial Intelligence Accuracy Disclaimer

SubGenius AI utilizes probabilistic machine learning speech-to-text and natural language models. You acknowledge and accept that:

  • Subtitles are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis. AI transcriptions and translations may occasionally contain phonetic errors, misspellings, homophone confusion, or contextual inaccuracies.
  • SubGenius AI does not warrant or guarantee that AI-generated subtitles or translations are 100% accurate, complete, or error-free.
  • Creator Responsibility: You are solely responsible for reviewing, auditing, and verifying all generated subtitles and translations in the Studio editor prior to publishing, broadcasting, or commercial distribution.

5. Acceptable Use Policy & Prohibited Conduct

You agree not to use the platform to process, generate, or distribute content that:

  • Creates non-consensual deepfakes, deceptive media, or synthetic impersonations of real individuals without their explicit written consent.
  • Depicts child sexual abuse material (CSAM), severe violence, terrorism, or hate speech violating Indian law (including the Bharatiya Nyaya Sanhita, 2023 and IT Act, 2000) or international criminal statutes.
  • Attempts to reverse engineer, decompile, crawl, exploit, or disrupt the platform's security mechanisms, edge endpoints, or client-side binaries.

6. Subscriptions, Credits & Refund Policy

SubGenius AI provides pay-as-you-go credit packs and subscription plans billed in advance via authorized Merchant of Record and payment processors (Lemon Squeezy / Stripe / Razorpay).

  • Consumed Compute Non-Refundable: Due to immediate GPU and computational infrastructure costs incurred upon speech synthesis, credit minutes once consumed are strictly non-refundable.
  • Cancellations: You may cancel recurring subscription packages at any time via your account portal. Cancellation stops future renewals while preserving your remaining credits through the billing period.
  • Billing Disputes: If you believe an erroneous charge occurred, contact [email protected] within 14 business days of transaction.

7. Limitation of Liability

To the maximum extent permitted under applicable law:

In no event shall SubGenius AI, its directors, developers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, goodwill, video views, advertising revenue, or business interruption, arising from your use of or inability to use the service.

SubGenius AI’s total cumulative liability arising out of or related to these Terms or the service shall not exceed the total amount paid by you to SubGenius AI in the three (3) months preceding the incident, or ₹1,000 INR (approximately $12 USD), whichever is greater.
